N.C. State has not ruled out legal action against LSU for what it believes may be a violation of North Carolina law after ex-men’s basketball coach Will Wade’s untimely and abrupt departure, despite LSU requesting legal immunity.

Why did LSU request it to begin with?

LSU general counsel Carlton Jones sent a mutual release and settlement agreement to N.C. State general counsel Allison B. Newhart on May 19. The proposed settlement, obtained by the News & Observer, states LSU should be free from legal liability or any other claims because the school agreed to pay the contract buyout on Wade’s behalf. Therefore, Jones posited, any issues related to Wade’s contract with N.C. State should be considered resolved.

N.C. State denied LSU’s request to be released from any legal claims, according to a letter from Newhart to Jones. Newhart stated the university agreed with Wade personally — not LSU, as an entity — to a reduced buyout and nothing else.

“A release was not negotiated or included as part of that arrangement,” Newhart wrote. “Moreover, LSU was not a party to the employment agreement, the negotiations or (Wade’s) buyout satisfaction agreement.”

Newhart said the university considers the buyout obligation satisfied, but only as it applies to Wade’s personal responsibilities. She emphasized LSU sent the request for release after N.C. State received payment and regarding an agreement with which it was not ever involved.

Wade resigned on March 25 through an email with his agent. His original contract buyout was $5 million if he left before April 1 and it dropped to $3 million after April 1. Athletic Director Boo Corrigan said on March 26, the day LSU announced Wade’s hire, the two parties settled on a $4 million buyout. This allowed N.C. State to sever ties and begin its own coaching search.

Jones emailed Newhart May 11 to request discussion with her or someone in her office about a “short release to accompany the buyout payment for Coach Wade.” The email came after N.C. State received the $4 million buyout payment from LSU via wire transfer on May 8.

On May 19, Jones sent Newhart a copy of the proposed mutual release and settlement agreement.

Additionally, Newhart’s letter says LSU’s payment to N.C. State — and whatever separate agreement it has with Wade — does not shield LSU from legal action. The “timing and circumstances … along with the LSU term sheet” raise questions about the university’s liability and involvement, it stated.

In the letter, Newhart said the university is investigating LSU for violations of the North Carolina Unfair and Deceptive Trade Practices Act by encouraging Wade to breach and terminate his contract. The letter also says N.C. State has “reason to suspect” LSU influenced actions to “delay or deny notice” of its recruitment of Wade to reduce buyout fees.

Immediately after his departure for LSU, some N.C. State fans on social media urged the university to pursue legal action for a breach of contract, stating Wade did not fulfill his duties as head coach, There was belief among vocal N.C. State supporters that he stopped providing the proper amount of coaching and investment in the latter portion of the season.

It’s unclear if the university planned to pursue an investigation against LSU before receiving the request of release.

University officials have declined to provide additional statements during this process.

Wade’s N.C. State contract covered six years and paid him $17 million. His contract with the Tigers is for seven years and $30 million.

When Wade was hired for his first stint coaching LSU in 2017, his contract was for six years and worth $15 million.

In one season coaching N.C. State, Wade led the Pack to a 20-14 overall record with an NCAA Tournament appearance at the First Four in Dayton, Ohio, last March.
