Can you drive a car or motorcycle without a muffler? What North Carolina law says.
Removing a muffler is one of the first things many car enthusiasts do when they get a new ride.
Taking a muffler off a vehicle can improve its performance by slightly increasing its horsepower by allowing higher levels of exhaust fumes to leave the engine.
Muffler deletes can also lead to excessive noise, which has been an issue in many areas of North Carolina.
A Charlotte resident posted to Reddit earlier this year about loud vehicles causing a disturbance while driving around uptown.
“I was just eating dinner outside in uptown and it would have been really pleasant if it wasn’t for constant extremely loud cars, motorcycles, and those 3 wheeled things circling around uptown,” the pose reads. “These people aren’t even going anywhere, just driving up and down the same [expletive] streets.”
Here’s what state law says about driving without a muffler.
Can you drive a car or motorcycle without a muffler in NC?
North Carolina state law requires all vehicles (including motorcycles) driven on highways to have mufflers to prevent “excessive or unusual noise, annoying smoke and smoke screens.”
Muffler cut-outs, or openings in exhaust systems that release more noise, are also illegal in North Carolina, state law says.
Are mufflers checked during car inspections in NC?
Inspectors are trained to look for signs of tampering in exhaust systems, including mufflers, according to Chapel Hill Tire. Cars with any signs of tampering will not pass inspection.
The check is part of the state’s emissions inspection, an initiative designed to limit the amount of pollutants released from motor vehicles.
What is the penalty for driving without a muffler in NC?
If your car is excessively loud, you could be fined for violating your local noise ordinance, which varies by city.
In Charlotte, a $100 fine can be issued after the first noise ordinance violation, according to the city. Fines of $500 and $1,000 can be issued for the second and third violations, respectively.
Raleigh residents can be fined $100 for their first noise violation, and $300 for each violation that occurs within a year after the first citation is issued, city law says.
